Terms and conditions and right of withdrawal

General terms and conditions (AGB's) and right of withdrawal for YTTP course bookings

1. Scope
These terms and conditions apply to all services offered by our yoga, pilates and reformer studio in Cologne, including but not limited to courses, memberships, trainings and retreats.

2. Conclusion of contract
The contract is concluded by booking courses, memberships, trainings or retreats via our website. The booking is made via the bsport tool, which is integrated into our website.

3. Services
a) Courses: We offer individual lessons, 5 and 10 tickets as well as monthly and annual memberships (12 and 24 months).
b) Trial training: One-off trial sessions can also be booked.
c) Trainings and retreats: We offer various training courses and yoga retreats, which can be booked separately.

4. Payment terms
Payment for the booked services is made directly via the website using the BSport tool. Accepted payment methods are specified during the booking process.

5. Memberships and cancellations
a) Monthly memberships: These can be cancelled with a notice period of 14 days to the end of the month.b) 12 or 24-month contracts: These contracts are binding for the agreed period. Early termination is only possible for important reasons, which must be proven in writing.

6. Cancellations and rebookings
a) Courses: Booked courses can be canceled or rebooked free of charge up to 12 hours before the start of the course.
b) Trainings and retreats: The cancellation conditions for training courses and retreats are described in detail in the respective booking process.

7. Liability
Our studio is only liable for damage caused by intentional or grossly negligent breaches of duty. We assume no liability for self-inflicted accidents or injuries during courses.

8. Data protection
Protecting your personal data is important to us. All personal data collected when booking and using our website will be kept confidential in accordance with legal regulations. For more information, see our Privacy statement.

9. Amendments to the terms and conditions
We reserve the right to change these terms and conditions at any time. The amended terms will be published on our website and come into force upon publication.

10. Final provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is Cologne. Should individual provisions of these terms and conditions be ineffective, the effectiveness of the remaining provisions remains unaffected.
These terms and conditions can be adjusted as required, depending on the specific requirements of your studio.

2nd Subject of the contract: Yoga training/continuing education

The yoga teacher training and continuing education courses give course participants the opportunity to acquire basic practical and theoretical knowledge in order to be able to work as a yoga teacher if they are personally suitable.

Yoga teacher training and continuing education can only be registered via our website www.yoga-to-the-people.de.

Für das Stattfinden eines Ausbildungsmoduls ist eine Mindestteilnehmerzahl von 10 Personen erforderlich. Sollte diese Zahl nicht erreicht werden, behält sich YTTP das Recht vor, die Ausbildung abzusagen oder auf einen späteren Termin zu verschieben. Wird die Ausbildung auf einen späteren Termin verschoben, steht den angemeldeten Teilnehmern ein Sonderkündigungsrecht zu, welches innerhalb von 7 Tagen nach Bekanntgabe des neuen Termins ausgeübt werden kann.

The course participant has the following right of withdrawal:
You have the right to cancel this contract within fourteen days without giving reasons. The cancellation period starts from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform us ((here: name, address, telephone number, e-mail address of the Yoga Academy)) of your decision to cancel the contract by means of a clear statement (e.g. a letter sent by post or e-mail).

To meet the withdrawal period, it is sufficient that you send the notification that you have exercised your right of withdrawal before the cancellation period has expired.

Consequences of withdrawal

If you cancel this contract, we must repay you all payments we have received from you immediately and at the latest within fourteen days from the day on which we receive notification of your withdrawal. For this repayment, we use the same means of payment that you used for the original transaction, unless something else has been expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.

Is the contractually agreed course fee not paid within the course participation confirmation 
set deadline (credit to the specified account), the contract is terminated retroactively 
and the training place expires.

Note on course fees:
According to Section 4 No. 21 letter a double letter bb Sales Tax Act, yoga teacher training courses are exempt from sales tax.

4th Rebooking yoga training
In addition to the statutory right of withdrawal, the course participant can rebook the training agreement by sending a written statement (post or email) to YTTP. The following regulation applies to rebooking fees, although receipt of the declaration by YTTP is decisive for the classification of the date of rebooking.

If you rebook up to 8 weeks before the start of the event, an additional 30% of the event price will be charged.

If you rebook up to 4 weeks before the start of the event, an additional 50% of the event price will be charged.

It is no longer possible to rebook less than 4 weeks before the start of the event.

If a rebooking is agreed, the terms and conditions applicable at the time of the rebooking, which are sent with the rebooking agreement, apply to the new booking. A rebooking is only possible with consent to the contractual provisions in force at the time of the rebooking.

5. Cancellation of yoga training
In addition to the statutory right of withdrawal, the course participant can cancel/terminate the training agreement by sending a written statement (post or email) to YTTP.

The following regulation applies to cancellation fees, although receipt of the declaration by YTTP is decisive for determining the date of cancellation/termination.

If you cancel up to 8 weeks before the start of the event, 50% of the event price will be refunded.

If you cancel up to 4 weeks before the start of the event, 25% of the event price will be refunded.

If you cancel less than 4 weeks before the start of the course and/or end after the start of
Course fees will no longer be refunded unless otherwise stated in these terms and conditions.

6th Early termination of training

Should a participant permanently disturb the homogeneity of a course, YTTP can terminate the training contract without notice.

Should a participant be permanently prevented from completing their training for health reasons and prove this with a medical certificate, he can end the training relationship. In this case, the course fee will be refunded on a pro rata basis for the unused course duration.

7. Interruption of training by course participants

If the course participant is prevented from continuing yoga teacher training after the start of the course due to illness, injury or pregnancy, he/she can make up for the course units that have not yet been completed within the following yoga teacher training course, provided that the course is not yet fully booked at the time of registration for rescheduling.

If the opportunity to catch up was available and was not used within 3 years (from the time of interruption), the right to catch up expires. There will be no refund of course fees already paid.

8th Organizer, time and place of training

YTTP — Baumgarten & Graffelder GbR, is the organizer of the training.
The yoga teacher training and continuing education courses are carried out in the premises of YTTP or BODHI Studio.

However, the organizer reserves the right to move the training (or parts of it) to another location. The general house law of the seminar house applies at the venue.

We reserve the right to change the course schedule for justified reasons, in particular due to illness of the instructor. Participants will be notified immediately in case of schedule changes.

9th liability
The participant must treat the premises, furnishings and items belonging to the seminar house with care. He is liable for damage that he negligently or intentionally causes to the seminar house.

YTTP's liability for property and financial damage, in particular items brought by the participant, such as clothing, valuables and money, is excluded.

By registering, the course participant expressly confirms the

This applies to physical, emotional and mental health.

Participation in yoga teacher training is at your own risk. The participants will follow the exercises and instructions on their own responsibility in accordance with their health performance. The assumption of liability for damage to health is expressly excluded.

10th Final provisions

If individual parts of the terms and conditions are ineffective, this does not affect the validity of the remaining parts. In this case, the parties accept the valid provision which comes closest in terms of content to the intended regulation of the ineffective component.

No oral agreements have been made regarding this training agreement. Amendments and additions to this agreement, including this provision, must be made in writing.

YTTP Yoga Retreat Terms and Conditions

General terms and conditions (AGB) Yogaretreat

1. Scope

1.1. These general terms and conditions (GTC) apply to the organization of retreats and other events (hereinafter: “yoga retreat”) by the organizer YTTP GmbH/YOGA TO THE PEOPLE (hereinafter: “organizer”) regardless of the venue of the booked yoga retreat.

1.2. The following conditions govern the booking of the yoga retreat.

1.3. The participant can only book accommodation directly with the specified seminar hotel, which is also solely responsible for the provision of all services associated with the accommodation in accordance with the contract.

3. Offer, acceptance, conclusion of contract

3.1. The description of the yoga retreat on the Internet website www.yoga-to-the-people.de represents a legally binding offer (offer).

3.2. The participant's written registration represents acceptance of the offer and thus the conclusion of a purchase contract.

3.3. After acceptance of the organizer's offer by registering, the participant will receive a confirmation of registration by email. Details of the order and payment are listed in this e-mail, and the invoice can also be found in this e-mail (order confirmation).

4. Saving the contract text

4.1. The participant can view the organizer's terms and conditions on the website www.yoga-to-the-people.de. The document can be printed out and viewed.

4.2. The contract text is saved by the organizer. This contract text is available to the participant upon request.

5. Payment of the course fee

5.1. The participant books the yoga retreat in writing with the organizer. 50% of the purchase price is due immediately upon booking. The prices listed on the website are final prices and include the currently valid sales tax.

5.2. The bill can be paid by bank transfer.

6. Participants' rights and obligations

6.1. The participant is required to provide their personal data truthfully and completely. The participant undertakes to report changes to their data promptly.

6.2. The participant must meet the necessary requirements for participation in the yoga retreat on their own responsibility and at their own expense. This applies in particular to booking transport.

6.3. Participation in a yoga retreat requires normal mental and physical resilience. If the participant is undergoing medical or psychotherapeutic treatment, he is required to discuss the participation with the doctor or therapist.

6.5. The participant is required to inform the organizer of any physical or psychological limitations or complaints before the start of the retreat.

6.6. The participant has no right to have the yoga retreat carried out by specific teachers. In the event of a short-term, unforeseeable failure of the announced teacher due to illness or disability, the organizer may provide a substitute teacher for the booked retreat. The replacement of the yoga teacher does not entitle the participant to withdraw from the contract or to cancel the contract.

7. Rights and obligations of the organizer/minimum number of participants

7.1. The scope of the services to be provided by the organizer extends exclusively to the implementation of the yoga retreat. The organizer does not provide or arrange any services in connection with the arrival and departure of the participant.

7.2. The organizer is entitled to change the time schedule or content of the retreat or to omit individual components of it, provided that this does not change the aim and overall character of the retreat.

7.3. The organizer undertakes to inform the participant of the impracticability due to failure to reach the minimum number of participants no later than six weeks before the start of the retreat. In this case, the course fee paid will be refunded immediately. The minimum number of participants is eight people.

7.4. The organizer is not obliged to reimburse the participant for cancellation or rebooking costs for transport and hotel services already provided elsewhere.

7.5. The organizer reserves the right to postpone or cancel the yoga retreat for reasons for which the organizer is not responsible. This is particularly the case if, if the announced yoga teacher is unable to attend, for example due to illness, no other teacher is able to take over the retreat or force majeure threatens or impairs the conduct of the retreat. The participant will then immediately receive a refund of the course fee. The participant has no further claims.

8. No right of withdrawal for yoga retreats

There is no right of withdrawal for consumers, Section 312g (2) (1) No. 9 BGB. Booking a yoga retreat is a service related to a leisure activity. According to Section 312g (2) No. 9 BGB, there is no right of withdrawal for such services.

9. Cancellation by participants — cancellation costs

9.1. The participant can cancel the contract in writing to the organizer at any time before the start of the retreat. If the participant cancels the contract, the organizer can claim lump sum compensation. Compensation is calculated as a percentage of the course fee as a percentage of the course fee after receipt of the participant's written cancellation statement:

- Up to 6 weeks before the start of the course: 20% of the purchase price
- Up to 4 weeks before the start of the course: 60% of the purchase price
- Up to 2 weeks before the start of the course: 100% of the purchase price

9.2. Until the start of the booked yoga retreat, the participant can provide a substitute participant who assumes the rights and obligations of the contract.

10. Withdrawal rights; termination due to special circumstances

10.1. The short-term replacement of the announced teacher by the organizer does not entitle the participant to resign or dismiss.

10.2. If the implementation of the yoga retreat is significantly hampered, endangered or impaired by force majeure, which was unforeseeable when the contract was concluded, both the participant and the organizer may terminate the contract. The mutual rights and obligations arise from legal regulations.

11. Liability

The organizer is not liable for third-party services, in particular for travel services.

12. Declaration of consent to image and video recordings

12.1. The organizer reserves the right to take pictures and video recordings during the yoga retreat for the use and publication of such recordings on its own website and on its own social media as well as for transfer to cooperation partners (teaching staff, seminar hotel,...) for use and publication on their websites and on their social media for the purpose of advertising and describing the services.

12.2. The participant hereby declares his consent to images and video recordings of his person in accordance with Section 12.1. of these Terms of Use.

12.3. The participant can revoke his consent on site before taking the pictures and video recordings vis-à-vis the person making the recordings.

13. Applicable Law, Jurisdiction

13.1. Only German law applies, excluding the UN Sales Convention on the Purchase of Movable Property (CISG) .13.2. Insofar as the customer is a merchant, legal entity under public law, special fund in Germany without a place of jurisdiction, Munich (Cologne Regional Court District Court) is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
